內(nèi)容摘要　　按照我國銀行業(yè)對外開放的承諾，我國銀行業(yè)將于今年年底全面開放人民幣業(yè)務(wù)，外資銀行將更大規(guī)模地進入我國市場，這將對我國銀行業(yè)競爭格局、市場秩序甚至金融安全產(chǎn)生重大影響。然而我國對外資銀行監(jiān)管的法制體系并不完善，外資銀行監(jiān)管工作也面臨著新的壓力和挑戰(zhàn)。研究我國對外資銀行監(jiān)管的法律制度對于保證金融行業(yè)的穩(wěn)定具有極其重要的現(xiàn)實意義。
　　本文采用比較分析，層層深入的研究方法，從介紹外資銀行及其監(jiān)管制度入手，分析了我國對外資銀行監(jiān)管制度存在的缺陷，進而提出了相應(yīng)的完善建議。
　　文章共分為四部分：一、外資銀行及其監(jiān)管概述。簡要介紹了外資銀行及其監(jiān)管的概念。然后對外資銀行監(jiān)管的原則以及巴塞爾體制中關(guān)于對外資銀行監(jiān)管的要求和內(nèi)容進行概括。二、我國的現(xiàn)狀及我國對外資銀行監(jiān)管的現(xiàn)狀分析。三、我國外資銀行監(jiān)管法律制度缺陷分析。指出我國在立法方面、監(jiān)管機構(gòu)設(shè)立、監(jiān)管實踐方面存在的缺陷。四、完善我國對外資銀行監(jiān)管法律制度的建議。重點論述了我國應(yīng)加強外資銀行監(jiān)管法律體系的構(gòu)建；應(yīng)完善外資銀行的監(jiān)管體系并提出應(yīng)在監(jiān)管實踐方面改變思維，完善監(jiān)管手段并加強與外資銀行母國及國際監(jiān)管組織的合作。

　　Abstract
　　According to our country banking industry to foreign countries opening up pledge, our country banking industry will comprehensively open Renminbi service to the end of this year, the foreign capital silver about to large-scale enters our country market, which will have the significant influence on our country banking industry competition pattern and the market order, even finance safely. However our country is certainly imperfect to the legal system of the foreign capital banking supervision and management, the foreign capital bank supervision and management work also is facing the new pressure and the challenge. Studies on our country stably to have the extremely important practical significance to the foreign capital bank supervision and management legal system regarding the guarantee finance profession.
　　This article uses the comparative analysis, layer upon layer the thorough research technique, obtained from the introduction foreign capital bank and its supervision and management system, has analyzed our country to the foreign capital bank supervision and management system existence flaw, then proposed corresponding consummated the suggestion.
　　The article altogether divides into four parts: First, foreign capital bank and its supervision and management outline. Briefly introduced the concept of the foreign capital bank and its supervision and management. Then about carries on the summary to the foreign capital bank supervision and management principle as well as the Basel system to the foreign capital bank supervision and management requests and the content. Second, our country present situation and our country to foreign capital bank supervision and management analysis. Third, our country foreign capital bank supervision and management law system’s flaws analyzing. Pointed out our country flaws which in the legislation aspect, the supervision and management organization establishment, the supervision and management practice aspect exists. Fourth, consummates our country to the foreign capital bank supervision and management law system suggestions. Elaborated our country to be supposed with emphasis to strengthen the foreign capital bank supervision and management legal framework constructing; Should consummate the foreign capital bank the supervision and management system and proposed should change the thought in the practice aspect, consummating the v method and strengthens with the foreign capital bank female country and the international supervision and management organization's cooperation.
